A Comparative Study of Civil Liability for Domain Name Cybersquatting in Iranian, EU, and US Legal Systems

Abstract
Domain name cybersquatting is a phenomenon where an individual, with malicious intent and for the purpose of profit, registers a domain name similar to another's trademark without any genuine commercial use. This practice poses a significant challenge for trademark owners and necessitates a comparative study of the foundations and enforcement mechanisms of civil liability arising from it. This article, employing a descriptive-analytical approach, examines this liability within the legal systems of Iran, the European Union, and the United States. For the first time, it comprehensively analyzes the registration rules and dispute resolution guidelines of IRNIC (the .ir domain name registration center) and compares them with the ACPA, Senate Report 106-140, UDRP, Rules for UDRP, Policy UDRP (version February 21, 2024), and WIPO Overview 3.1. The findings indicate that US law, with the ACPA and its provision for statutory damages ranging from $1,000 to $100,000, along with 8 factors for establishing bad faith, offers the most complete protective system. The European Union, by leveraging the UDRP (with over 1,400 documented decisions in WIPO Overview 3.1) and specific regulations for the ".eu" domain, has taken effective steps. In Iranian law, Article 66 of the E-Commerce Law, despite its age, lacks the element of bad faith and appropriate civil remedies. Although the IRNIC dispute resolution guidelines share a similar structure to the UDRP and designate the WIPO Arbitration Center as the dispute resolution authority, they lack full efficacy due to insufficient judicial precedent and the absence of statutory damages. The article concludes by offering suggestions such as amending Article 66, introducing statutory damages, and updating the IRNIC guidelines.
