Abstract
In the past, when there was no law or precise framework for punishing criminals, each group and tribe would regulate punishment according to its culture to punish the offender for his actions. There was also a culture among Iranian tribes. In some regions, even though other countries have specific laws for punishing individuals, tribes still follow their own unwritten laws. In some parts of Iran, the situation is so serious that even the police cannot intervene. Among them, the Bakhtiari tribe is one of the large tribes that still resolves its problems with customs and habits in some cases. The purpose of this study is to examine customs and habits in preventing crimes in the Bakhtiari tribe. The findings of this study show that in tribes such as the Bakhtiari tribe, when a murder occurs, people are divided into two groups: the perpetrator and the victim. The consequence of this gap in society is the occurrence and continuation of various crimes by these two groups against each other. In such circumstances, custom and habit can prevent crimes and end conflicts.
