Collateralization of Intangible Assets in Islamic Jurisprudence and Iranian Law: A Comparative Study with Common Law

Abstract
The collateralization of intangible assets, as a novel subject in the fields of law and Islamic jurisprudence, has gained increasing importance with the rapid expansion of digital technologies and intangible property. This study aims to examine the feasibility, obstacles, and challenges of collateralizing intangible assets in Iranian law and Islamic jurisprudence, while providing a comparative analysis with the common law system. Given the limitations of Iranian law and Islamic jurisprudence—which are primarily based on the collateralization of tangible property—this research seeks to analyze theoretical and jurisprudential foundations, jurists’ opinions, and relevant legal provisions regarding the collateralization of intangible assets. In contrast, the common law system has established more precise mechanisms for collateralizing intangible assets, which may serve as successful models for improving Iran’s legal framework. Using a descriptive-analytical and library-based methodology, the findings reveal that although significant challenges exist in collateralizing intangible assets within Iranian law and Islamic jurisprudence, it is possible to establish an appropriate legal framework for such assets by drawing on the experiences of other legal systems, such as common law, and implementing necessary reforms. Ultimately, the research provides recommendations for improving and reforming Iran’s existing legal framework, suggests avenues for future research, and offers practical solutions for the collateralization of intangible assets. The practical and theoretical implications of this study for legal and jurisprudential discourse, as well as for academic and economic communities, constitute its major contributions.
