Abstract
Smart contracts, as one of the most prominent applications of block‌chain technology, have today extended beyond the mere transfer of digital assets and cryptocurrency transactions and have acquired the capacity to provide a framework for the formation and performance of legal contracts, including mortgage agreements. The application of this technology in the collateral system, through automating the performance of obligations, accelerating the realization of the mortgagee's rights, preventing unauthorized dispositions of the mortgaged property, and enabling the pledge of encrypted digital assets, can significantly enhance the efficiency of this system. However, the application of smart contracts to mortgage agreements within the Iranian legal system faces various challenges, including uncertainties concerning the pledge of digital assets, the interpretation of traditional legal concepts such as "specific identified property" (ʿayn-e moʿayyan) and "delivery"(qabḍ), technical vulnerabilities, programming errors, dependence on oracles, and the lack of flexibility at the enforcement stage. Despite these challenges, domestic legislative developments and international legal instruments indicate that contemporary law is gradually moving toward recognizing intangible assets as capable of being mortgaged and adopting a dynamic interpretation of traditional legal institutions. Accordingly, it appears that, by adopting a dynamic interpretative approach toward existing legal provisions and developing specific rules governing smart contracts, the potential of this technology can be utilized to rethink and develop the institution of mortgage, thereby enhancing the system of securing obligations under Iranian law.
