تحلیل تطبیقی چالش‌های حقوق خصوصی ناشی از فناوری هوش مصنوعی در نظام حقوقی ایران

چکیده
ظهور و گسترش هوش مصنوعی در دهه‌های اخیر، مرزهای سنتی حقوق خصوصی را دستخوش تحول اساسی ساخته و مفاهیمی چون اراده، تقصیر، انتساب و شخصیت حقوقی را با پرسش‌های بی‌سابقه روبه‌رو کرده است. در نظام حقوقی ایران که بر مبنای الگوی انسان‌محور و مسئولیت مبتنی بر تقصیر شکل گرفته، کنش‌های خودکار و غیرقابل پیش‌بینی سامانه‌های یادگیرنده جایگاه فاعل انسانی را متزلزل ساخته و خلأهای گسترده‌ای در زمینه تعیین مسئول، جبران خسارت و حمایت از داده‌های شخصی ایجاد کرده است. این مقاله با روش توصیفی–تحلیلی و تطبیقی، چالش‌های مذکور را در پرتو اسناد و مقررات اتحادیه اروپا—به‌ویژه قانون هوش مصنوعی مصوب ۲۰۲۴ (EU AI Act) و مقرره‌ی عمومی حفاظت از داده‌ها (GDPR 2016)—بررسی می‌کند. نتایج پژوهش نشان می‌دهد که نظام حقوق خصوصی ایران در سه محور اساسی—مسئولیت مدنی، صیانت از داده‌ها و مالکیت فکری—فاقد ساختار منسجم و پاسخ‌گو در برابر واقعیت‌های فناورانه است. برای رفع این نارسایی‌ها، مقاله چهار راهکار بنیادین ارائه می‌دهد، نخست، بازسازی الگوی مسئولیت بر پایه‌ی معیار درجه‌ی کنترل و پیش‌بینی‌پذیری رفتار سامانه‌های هوشمند؛ دوم، تدوین قانون جامع حمایت از داده‌های شخصی با محوریت نهاد نظارتی مستقل؛ سوم، طراحی سازوکار بیمه‌ی اجباری برای فعالیت‌های پرخطر هوش مصنوعی؛ و چهارم، بررسی امکان اعطای شخصیت حقوقی محدود یا کارکردی به سامانه‌های خودمختار. این پیشنهادها زمینه‌ساز گذار از حقوق انسان‌محور به نظام حقوقی فناورمحور و عدالت‌مدار خواهد بود و تعاملی سازنده میان ایران و نظام‌های پیشرفته در عرصه تنظیم‌گری هوش مصنوعی فراهم می‌سازد.
